Long story short, my neice is spending the summer with us and may end up staying for an indefinite period of time. She is on state medical in Texas; however, we are in North Carolina. My question is would we be able to obtain TRICARE coverage for her?

So, is legal custody the same thing? Not temporary custody. The parents would have to take me to court to regain custody type situation.

If you are granted legal custody then she becomes your dependent. You will, of course, have to provide the court documents to prove this but everything should be the same as if she were your own child.
