My boyfriend has been going through a long divorce process since 2006 (should be finalized this month)...He had 2 home, one which he filed BK for and it was discharged 5/06 sold at sheriff sale 02/07.. As for the 2nd home which Va loan was use to purchase, During the beginning of his divorce he was orderd to pay temp alimony in which she was suppose to also pay house payment..Long story short, she didnt, she filed Bk I believe in June of 2007 and the during that time the home was already in the foreclosure process...This home was sold at sherrif sale Sept 2008...Where not sure at the moment at what it sold for...But my question is would he be able to recieve another VA loan? And if so how soon?

it will be september 2010 at the very earliest before he would be able to qualify for another VA loan or any type of conventional or FHA loan. VA will be reusable only if VA did not lose anything from the sale of the home and whatever loses VA takes, he would have to pay back in order to reuse the entitlement.

So VA foreclosure waiting period dosent start from BK discharge??? He didnt file BK but his exwife did and the discharge date shows 10/2007....So wouldnt he be able to use VA loan 10/09, 2years after that date?

The time table is a solid 2 years from the discharge of the bankruptcy with no derogatory credit afterwards. 3 years on the foreclosure but there are exceptions that can shorten it to 2 years however most lenders aren't accepting anything on an exception basis right now and that's not likely to let up.

The default time table for chapter 7 bankruptcy is two years from date of discharge. It can be exceptioned to 1 year.

For chapter 13 it's 1 year from the date of filing.

For a Foreclsoure, it's 3 years, but can be exceptioned to 1 year, just like with the chapter 7.
