Even though you may not have qualified for CRSC in the past, the National Defense Authorization Act of 2003 expanded CRSC eligibility to retired military personnel who have a combat-related Department of Veterans Affairs (VA) disability rating between 10% and 50% effective January 1, 2004. Your branch of service will determine which disabilities (if any) qualify as combat-related.
With the inception of the CRSC program on June 1, 2003, the following eligibility requirements were established: Retirees had to apply to their respective branch of service to be approved for CRSC. Retirees had to be in receipt of VA compensation. Retirees had to be in receipt of military retired pay or be in a suspended pay status due to receipt of VA compensation. Retirees had to have an approved combat-related VA disability rating of 60% or greater. Retirees having an approved combat-related disability associated with a Purple Heart had to have a rating of 10% or greater. Retirees had to have 20 years of active service or, for reservists, 7,200 reserve points in order to be eligible. Effective January 1, 2004, CRSC eligibility was extended to retirees with combat-related VA disability ratings between 10% and 50%. Additionally, reservists needed only 20 years of qualifying service (supported by documentation from the applicable branch of service such as a 20-year letter, retirement orders or a statement of service) in order to be eligible. The other eligibility requirements remained unchanged. Please note that qualified reservists will not receive CRSC until they begin to receive retired pay at age 60. Temporary Early Retirement Authorization (TERA) retirees are not eligible to receive CRSC unless they have returned to active duty and accumulated enough service time to meet the 20-year requirement before retiring for the second time. |

In my post above regarding VA withholding $40 for two months, you wrote, "Until a retiree reaches 50% service connection there is a military retirement offset. At 50% concurrent receipt starts. It is graduated at 10% increments.

VA was not aware (they say) that my current award of 20% was approved CRSC and that is why they withheld the $40. I faxed them a copy of my award ltr so hopefully, that will get it straight. I have sent VA a NOD regarding the recent ruling. I will send you what VA based the ruling on and ask if you feel I have a good appeal. Thanks again for this forum and you're dedication to helping veterans! It has been very helpful to me and I know to other veterans.

For those brothers and sisters who think the VA is slow, until you deal with CRSC "you ain't seen nothin' yet!" Five branches, five sets of interpretation and requirements, whew! Hi Dave, i haven't talked to you for a while, just a couple weeks ago i recieved from the v.a, my last claim for chloracne which was denined because i had no new material to send them as such. they did how ever grant me service connected for my diabetes at 10% and o% for my peri. neopathy in both legs but was granted those to be service conected also because of agent orange exsposure while in viet nam , my question since i'm already at 50% disabilty for my hearing loss, will my % be raised from 50%, just wondering since i can't get nothing from my v.a. as answers

Using VA math, you may be bumped to 60%. However since I am not in the office, but off on a weekend, the chart is not accessable. When a vet is rated 50% that leaves 50% left for other conditions to be rated on, so 10% of the remainder would be 5%. If VA rounds up the 5% to 10% you will be increased. The important issue is you are SC for diabetes and peripheral neuropathy. So monitor those issues diligently and as they increase in severity ask for an increase in compensation. Each time you go to the doctor and the nurse and doctor ask how are you? Unless you have no reason to be at a doctors office, do not say OK or fine. Answer by saying "my hands and feet are numb, tingling and hurt." |

thanks Dave, I have a doctor appointment this coming feb. for the numbness in my legs and pain, its getting so bad i can't hardly do my job at work anymore, now my employer is trying to get me to retire which i'm not old enough yet won't be for 3 more years. I have days the pain is so bad i have to sit , they swell up and pain is unbearable. will have to just wait til my appointment with the v.a. doctor and see what he has to say. again thank you Dave you and your family have a good thanksgiving we all have so much to be thankful for. your friend Bill |

DAVE I HAVE A RATING OF 20% WHICH IS THE TOP IN MARYLAND I EVEN HAVE IT ON MY LETTER SAYING THE RATING WAS ASSOCIATED WITH HERBICIDE EXPOSURE. I HAVE TYPE 2 DIABETES.

Diabetes type 2 is rated based on impairment and affect on the veteran. Most of my clients were awarded 20%. A few 10%, a few 40%, one was granted 100% including the secondary conditions.

Hello all
I retired from the Army Oct1,2004 with initial 80% DV from the VA. I submitted a application for CRSC afew months after retirement.I was disapproved jan 2006.I resubmitted for a reconsideration. I was approved Apr 2007 at 70% CRSC.I will be receiving crsc retro pay begining from retirement date to Apr 2007. DFAS have past their crsc pay deadline x2.Good luck to you all and God Bless you all. |

A friend of mine just came down with prostate cancer and he filed for compensation/disability and is getting it now. He was on land.
I boarded my ship which had just returned from Nam and I now have prostate cancer and am having a tough time getting approved. Anyone have any advice for me? outlawric |
