I saw a student drive by me in the parking lot yesterday after school was dismissed. He had a bulging cheek and I would assume it contained a nice chew. Now, tobacco is a no-no on school grounds and it results in a 5 day out of school suspension. (When we do an OSS the kids go to the courthouse and stay there during the suspension time.)

I have already dealt with the student but I want your feedback on some choices that could have been made.

1. Suspend because you thought he was chewing.
2. Turn your head and disregard it because school was out.
3. Don't base a decision upon assumptions.
4. Don't worry about it; school is out in 26 weeks.

What do you think? (I'll tell you what I did a little later.)

Unless you stopped him and saw it was a Chew then for all you know it could have been Chewing gum. You would lose in court....#3

School was out, he was in his own vehicle (I assume) and he was leaving. Unless you actually saw him put it in his mouth while walking to his car, you really can't do anything. I would however pull him aside the next day and remind him of the rules.

If he was on the bus when you saw him, then that is the bus drivers territory and you should let them deal with it. Again, you can pull him aside for the warning.

I think taht what SHOULD be done, and what is ALLOWED to be done often differ so greatly that little is ever correct.
Susspending a highschool kid for chew would be about the same as NJPing a LCPL for underage drinking in his barracks room. Some times a kid just needs a good asschewing.

Well if you were a Cpl. or Sgt. thrash him, if you were a Ssgt or Gunny give him a stern talk then have your Cpl. - Sgt. thrash him. if you were a 1stSgt. have him thrown in jail and anything else you can hang on him! Angry Whip

Not true Tom. As a school official all I need is "reasonable suspicion". If I feel like I had that, Icould legally ring a kid up.

Since you don't know for a fact that he was chewing I'd have to say have a talk with him about it, letting him know the consequences of his actions.

He wins because he knows he was busted (possibly) but is being given a second chance. You win because you didn't have to deal with his parents over this and hopefully your wise words of wisdom will guide him the correct way.

Do I get a cookie?

Yes, he was in his own vehicle but still on school grounds. Actually, he could have been 5 miles from school and not arrived home yet, and I could still pursue a suspension. Legally the school is responsible for the student until they get to their home.

The school administrators deal with all bus issues. Even though they are privately contracted, we are still responsible for correcting the kids.

If he was already headed off of school property, just let him go.

If he wasn't headed off, and you could stop him, just stop him to ask some questions. While it might take a warrant to question what was in his mouth, eventually he'd have to spit and you'd have your evidence. Wink

At least he wasn't lighting a joint up as he was pulling out.

Just talk to the little turd and tell him that you'll jack his $hit up the next time you see him with it on school property.

Not if you were in my school district. If you drive, once you leave the parking lot and grounds, you are on your own. If you are on the bus, the school responsibility extends to the bus stop, before and after school, but once you leave that bus stop, you are on you own. If you walk, you are on your own once you leave school grounds.

If he was on the bus when you saw him, then that is the bus drivers territory and you should let them deal with it. Again, you can pull him aside for the warning.

Ours does too. If you get into a fight on the bus, the driver makes a phone call and the principals come right out to where ever the bus is and remove you from it. How's that for action?

I called the young man in today and told him what I saw and told him he could not speak until I was done.

I then went on to say that I had a good idea he was chewing and he knows for sure what he was doing. I then added that, since I had not seen the actual substance, I would assume he was chewing a big wad of gum...or maybe a Snickers bar.

I then told him that he could consider this a little friendly reminder that consequences for chewing are indeed serious and I would be watching.

I guess I believe that rather than assuming the worst in kids, even though I believe I know the truth, I will assume the best....until they prove me wrong.

So I did not suspend him, I did not verbally berate him, and I did not turn my head. There can be a happy medium when dealing with kids.
