By "hiding behind" the Feres Doctrine, the Marine Corps, the medical corps and the United States Government should hang their heads in shame.

Medical mistreatments happen all the time we must not forget that Doctors are not God/or perfect I doubt the military will not take care of this Marines family(kid). Some *******s will thrive of this video and turn it into a anti war theme.God bless this Marine and his family but don't turn this into a anti military video many civilians have died from Doctors mistreatments. It is sad but true.

WOW – this is so incredibly sad. My heart goes out to his family. I agree the doctrine needs to be either revised or done away with. I agree that there should be some form of limitation set on the military members suing the gov’t for injuries sustained during service. However, what happened to this Marine is completely off the charts. It was negligent of that doctor to not follow up to ensure notification. And the misdiagnosis in Iraq, I can see that happening because of the stresses of the severely wounded coming in, but to mistake melanoma for a wart? That is a bit off the charts too. Was it even a doctor that made that call or was it a Corpsman? That is important information. Sorry if it states specifically in the vid. Even if it does, it’s a journalist piece and may not be accurate on that count.

What also gets me is the military not paying for the funeral and the sad disbursement of benefits after such an example of neglect. It’s not like the Marine was on patrol and got shot or attacked with an IED or something. He could have received treatment and may have lived had notification been done and the misdiagnosis not occurred. Those are important factors IMO.

The doctrine would better serve if it stated something specific for negligent cases being able to obtain some sort of relief. Death due to inadequate care, such as poor timeliness due to staffing and being in a war zone I can understand not being able to sue. That’s not the case with this Marine.

WoW very sad and disturbing and yet we know when we sign that dotted line we give up our freedom to fight for it and in the end like we were told we were just a number.

Makes one think!!!

Hopefully through that families suffering and pain but yet determination things will change.

A V.A. Service Officer once told me the V.A. dosen't work for the benefit of the veteran, but for the benefit of the government, to disqualify the vet. After dealing with V.A. medical for the last 14 + years and seeing this video, I believe it! Its a @#$%&*! Disgrace what we have to take, after all we've given.

AIDS-Infected Marine Sues U.S. Over Transfusion of Tainted Blood

Martin Gaffney, 42, AIDS Victim Who Sued U.S. for Malpractice

Anyone remember this case? If and when you do have a case the government will attempt to ruin your character and/or just wait until you die.

Thinking about all this, I as one went to sick bay 3 times, once for boot, once when I cracked my head open on an overhead angleiron in a security alert and at the time I was discharged. We had Corpsman come in for shots and piss tests, but NEVER A YEARLY Physical.

I have run across in the civy world at the VA with guys that were in my timeline and they have a f'n book of medical pages in their med file. my question, when did they have time to train or deploy at anytime?

This saddens me and I feel for this family. At times like this I feel the shame that the whole country should feel in treating Vets like this.
It also piss's me off that Vets should recieve this sort of treatment, but it does not surprise me.

Proud American and Proud Marine and ashamed at the same time!!!!!!!

Yeh maybe at the point that he died, but thats just the point he should have never reached that point. The first Doctor to diagnose him should have done something right then and there. Not just note it in his record. and the second doctor wasn't any better telling him to have it looked at when he got back state side. If either one of them had done something imediatlly there would have been a good chance that he would still be serving out his career in the Corps.

God bless Marine. See you on the Golden Streets of Heaven.
