My son was accused of rape. It was a false claim. He went to court marshal and was found not guilty. What it boiled down to, the alledged victim lied and once on the stand my son's defense attorney through her testimony and her doctor's report proved it. She is shielded by the rape shield laws and never will be held accountable for what she did. Even though my son is not guilty, he will still have the original charge on his record. All of this could have been prevented if the victim's advocate program wasn't so slanted. The woman involved is out there, and she will strike again and believe me, as she has acted in the past and this could not be used in his trial, she is a powder keg ready to just do it again. Understand, I have been a social worker for 18 years. This is my area of expertise. I know what the Army's "safety training" consists of. WE are all responsibile for our own safety. We are also responsible for how we convey our sexual availability. I know my son isn't the only one out there that has faced a false claim. I also know that real rapes do happen. False claims don't make it easier for the real rape victims to get assistance. If false claims are continued to be allowed and shielded and then go to this degree through the military justice system, no soldier, man or woman will be safe. The civilian system has mediation first, and then and if and when all information is revealed criminal charges are met out for the real victim. There are three distinct areas that must be taught, trust me, I know you aren't getting all the information you need to protect yourself. I also had the occasion during his trial to meet with two rape victims who were angered that this woman, a higher rank than my son, was allowed to make the false claim in the first place. Women are empowered when they, too, are held accountable for their actions. The Army needs to seek this equality, protect all soldiers, because as it stands, no soldier is safe.
