SUBJECT: RETROACTIVE STOP LOSS SPECIAL PA

REF: HR 2346 WAR SUPPLEMENTAL APPROPRIATIONS ACT, 2009, PUBLIC LAW 111-32, SECTION 310
1. THE PURPOSE OF THIS MESSAGE IS TO ANNOUNCE ARMY POLICY AND PROCEDURES FOR IMPLEMENTATION OF RETROACTIVE STOP LOSS SPECIAL PAY.
2. RETROACTIVE STOP LOSS SPECIAL PAY IS A SPECIAL PAY FOR MILITARY MEMBERS, TO INCLUDE MEMBERS OF THE RESERVE COMPONENT, FORMER AND RETIRED MEMBERS UNDER THE JURISDICTION OF THE SECRETARY WHO WHILE SERVING ON ACTIVE DUTY AT ANY TIME FROM 11 SEPTEMBER 2001 TO 30 SEPTEMBER 2009, THEIR ENLISTMENT OR PERIOD OF OBLIGATED SERVICE WAS INVOLUNTARILY EXTENDED OR WHOSE ESTABLISHED DATE OF SEPARATION, RELEASE FROM ACTIVE DUTY, OR APPROVED VOLUNTARY RETIREMENT WAS INVOLUNTARILY SUSPENDED BY AUTHORITY OF EITHER SECTION 123 OR SECTION 12305, TITLE 10, UNITED STATES CODE (COMMONLY REFERRED TO AS STOP LOSS AUTHORITY). THIS SPECIAL PAY IS SPECIFICALLY AUTHORIZED TO BE CLAIMED RETROACTIVELY AS PROVIDED IN THIS MESSAGE.
3. EFFECTIVE 21 OCTOBER 2009, ELIGIBLE SERVICE MEMBERS, AS PROVIDED IN PARAGRAPH 2 ABOVE, WILL BE PAID $500.00 FOR EACH MONTH OR PORTION OF A MONTH RETAINED ON ACTIVE DUTY PAST:
A. CONTRACTUAL EXPIRATION OF TERM OF SERVICE (ETS) OR, IN THE CASE OF THE RESERVE COMPONENT, A CONTRACTUAL EXPIRATION OF TERM OF SERVICE IN THE SELECTED RESERVE.
B. AN APPROVED SEPARATION DATE BASED ON AN UNQUALIFIED RESIGNATION OR RELEASE FROM ACTIVE DUTY (REFRAD) OR, IN THE CASE OF THE RESERVE COMPONENT, AN APPROVED REQUEST FOR TRANSFER TO THE INDIVIDUAL READY RESERVE (IRR) (PROVIDED THE SERVICE MEMBER HAS COMPLETED THE STATUTORY OR CONTRACTUAL EXPIRATION OF TERM OF SERVICE IN THE SELECTED RESERVE).
C. APPROVED RETIREMENT BASED ON LENGTH OF SERVICE.
D. APPROVED MEMORANDUM OF RESIGNATION FOR OFFICERS SERVING BEYOND THEIR MILITARY SERVICE OBLIGATION AND/OR ADDITIONAL SERVICE OBLIGATION.
E. IN THE CASE OF THE READY RESERVE (IRR, IMA AND OTHER INDIVIDUALLY MANAGED SERVICE MEMBERS), MILITARY SERVICE OBLIGATION OR CONTRACTUAL TERM OF SERVICE, WHICHEVER IS LATER.
4. RETROACTIVE STOP LOSS SPECIAL PAY WILL BE PAID IN A LUMP SUM FOR THE MONTHS SERVED IN STOP LOSS STATUS. PAYMENTS SHALL NOT BE MADE FOR BOTH RETROACTIVE STOP LOSS SPECIAL PAY AND STOP LOSS SPECIAL PAY FOR THE SAME PERIOD OF SERVICE.
5. RESERVE COMPONENT SERVICE MEMBERS RETAINED UNDER STOP LOSS WILL ONLY ACCRUE RETROACTIVE STOP LOSS SPECIAL PAY WHILE SERVING ON ACTIVE DUTY IN THEIR STOP LOSS PERIOD UNDER THE PROVISIONS OF 10 USC 12301(G), 12301(H), 12302. SERVICE MEMBERS PLACED ON 12301(D) ORDERS, IN THEATER, THAT WERE USED TO ACCOUNT FOR TIME BEYOND THE SERVICE MEMBER'S ETS OR MSO ARE ELIGIBLE FOR STOP LOSS SPECIAL PAY DURING THE PERIOD COVERED BY SUCH ORDERS.
6. DFAS WILL DETERMINE APPLICABLE TAX EXCLUSIONS FOR ANY RETROACTIVE STOP LOSS SPECIAL PAY EARNED WHILE IN A COMBAT ZONE TAX EXCLUSION (CZTE) AREA.
7. EACH SERVICE MEMBER OR SURVIVOR MUST FILE A CLAIM FOR RETROACTIVE STOP LOSS SPECIAL PAY NOT LATER THAN 21 OCTOBER 2010. SERVICE MEMBERS OR SURVIVORS WHO BELIEVE THEY ARE ELIGIBLE FOR RETROACTIVE STOP LOSS SPECIAL PAY MAY SUBMIT AN ELECTRONIC CLAIM AT HTTPS://WWW.STOPLOSSPAY.ARMY.MIL.
8. THE NECESSARY DOCUMENTATION TO SUPPORT A CLAIM WILL BE THE FOLLOWING:
A. FOR ENLISTED SERVICE MEMBERS: DD FORM 214 AND DD FORM 4 ENLISTMENT/REENLISTMENT/EXTENSION CONTRACT(S). SHOULD A SERVICE MEMBER NOT HAVE THESE DOCUMENTS, THEY SHOULD PROVIDE A LEAVE AND EARNINGS STATEMENT (LES) AND REQUEST ASSISTANCE THROUGH THE BELOW POC. FOR INDEFINITE ENLISTED SERVICE MEMBERS, A MEMORANDUM/OR CORRESPONDENCE DOCUMENTING DENIAL OR SUSPENSION OF APPROVED RETIREMENT MUST BE PROVIDED WITH THE APPLICATION.
B. FOR OFFICERS: DD FORM 214 AND MEMORANDUM DOCUMENTING DENIAL OF REQUEST FOR OR INVOLUNTARY AMENDMENT OF RETIREMENT/RESIGNATION/REASSIGNMENT TO THE IRR (USAR OFFICERS). SHOULD A SERVICE MEMBER NOT HAVE THESE DOCUMENTS, THEY SHOULD PROVIDE A LEAVE AND EARNINGS STATEMENT (LES) AND REQUEST ASSISTANCE THROUGH THE BELOW POC.
C. IN THE CASE OF ARMY NATIONAL GUARD SERVICE MEMBERS, IN ADDITION TO THE ENLISTED AND/OR OFFICER DOCUMENTS, INCLUDE THE DA FORM 4187 FOR STOP LOSS ADJUSTMENT OF ETS, SEPARATION DOCUMENTATION NGB22, AND/OR DD FORM 1966.
9. SERVICE MEMBERS SHOULD ADDRESS ALL ISSUES AND CONCERNS TO THE BELOW POC.
10. POINT OF CONTACT FOR INQUIRIES IS MAJ R. WHITLEY, RetroStopLossPay@CONUS.ARMY.MIL.
11. EXPIRATION DATE OF THIS MESSAGE IS 30 OCTOBER 2010.

^^^ Rob Rodriquez is the only one that cares about Sticky posts. I don't know why but he is the guy that removes them and you have to ask for permission.

Officially you should ask Kurt but I think either his kid is back on Leave from the ME or he is taking a vacation right now.

I'm not a Mod right now otherwise I would do it but I am sure none of the Army Mods really care if you do this yourself.

FormerEmbassyMarine my friend, thank you very much for the information.

I got a chuckle (I can at it laugh now) when I retrieved my involuntary extension orders from January 2003 with my adjusted ETS date that read 20311224 which would have been one week before my 67th birthday.

Needless to say when I read it I could only think BOHICA, I'm really F'd this time.

So anyone know when the amounts will actually be dispersed? I'm assuming before Christmas to hopefully entice spending, and while we've all seen the snafus regarding the new GI Bill payments, perhaps they've learned from that and this will go smoother?

Also, are those of us receiving these payments going to have it taxed as 2009-(hopefully not 2010) income and/or would the months we were overseas be tax free?

No word on any timetables.
The tax exemption question is addressed in Para. 6 of the ALARACT above. I would assume the retro payment will go onto the W-2 for the tax year it was payed out in and therefore any portion taxable would be charged during the tax year the payment is actually received.

Army gets 4,200 applications for retroactive stop-loss payments

The Air Force has been getting about 90 applications per day, said Retherford, who did not provide any information on Navy or Marine Corps applications.

The reason why people are required to submit a claim for compensation is that the services’ did not keep reliable records on who had been stop-lossed, Retherford said.

Those eligible for compensation have to provide proof that they were stop-lossed, such as a deployment order, he said.

“If the member doesn’t have the documentation, then the service will, based on the claim, attempt to find the documentation to support the claim, but it has to be shown and proved, there was no other way around it because records in a lot of cases – as I mentioned – were not maintained,” Retherford said.

Thanks to FormerEmbassyMarine, I googled "Sam Retherford" and found this blog and podcast talking all about the retroactive payment process:

The best thing I got out of it was that according to Mr. Retherford, the goal is for a 30 day turnaround from receiving your claim to approving or denying it and sending it to to DFAS. Obviously, if you chose direct deposit, you'll get it a little faster. Again, I hope that the recent snafu with the new GI Bill payments, this process will benefit from its AAR.
