Hi; my husband and I are both in the military. We've been married just over a month--since May 19. I want an annullment, he doesn't. I've spent over $4,000 (my entire bonus) since we got married. The apartment is in my name and I have a one year lease I can't get out of. I bought all the furniture and have paid all the bills and for all the groceries. I bought a second car and have been paying for all the gas and auto insurance, because he's always "too broke," and promises to pay me back the next paycheck. I'm tired of it an want an annullment. I tried to tell him the other day but he wouldn't listen. My counselor through military one source said I should just let him be served papers and the sheriff can make him move out right then and there, since the apartment is in my name. I'm a SPC and he's now an E-1. He was an E-2 when we got married but got an Art 15 and lost rank because of intoxication on duty less than two weeks after we got married.
My question is...since I'm in a legally-binding lease, can the Army still pay me my partial BAH? I can't even afford half the rent out of my base pay and I have a Top Secret clearance and can't afford to just stop paying rent. I have an appointment with legal on Monday, but just wanted to see if anyone had been in a similar situation and could provide any much-needed insight.
Have you talked to your 1st SGT? They don't necessarily have to make you back into the barracks just because you are single. My son can get BAH if he desires to live off post and is a CPL.
If you are allowed to live off post, y`ou will go from BAH w/dependents to BAH w/o dependents which is approximately 75% of BAH w/dependents.
I thought you can't get BAH w/dependents if you are both military because both won't be dependent on each other? I'm confused now..lol My son married a army gal and that's what was posted when I asked if they would get BAH w/dependents..
Also i believe if the Army has you move back into the barracks you might be able to get out of your lease if the Soldier and sailor act provision is in it.

You can if you have kids, but only the senior member draws. Not sure why it was brought up here though. It's N/A
OP is the car solely in your name? If so, sell one, leave him with none.
Why did you marry him in the first place? How did you buy a car, furniture, etc all in the span of a month and he never pays and now it's an issue? that's only, like one (maybe 2) pay periods.
Oh, well it's not just that I've paid for everything, it's that he spends his money on things he doesn't really need--like alcohol and cigarrettes, until it's gone, then doesn't have money for utitilites when we need it. Other than money, he's on probation for 6 months after the article 15, and if he screws up in the least they'll kick him out.

Why? If you're really that interested in your clearance you'll actively work to get your expenses and debt down so you can keep it. There's no reason for you, as an SPC who doesnt make that much and with no familty, two have the expense of 2 cars and an apartment, and you will probably be told that at legal. It's financially irresponsible on your part.
