I am an NG soldier deploying to Iraq. I am married to a NG soldier who is home on drill status. Can I claim her as a dependent to receive the 'with dependent' rate? I have heard several different answers and would like to know where the regulation is so I can take that to finance with me. Thanks

While you are mobilized and your wife is not, you ARE entitled to Dependant BAH because she, as a drilling NG receives no BAH for IDT drills. So at the time she is actually a civilian and your dependant. Now if the situation changes (she deploys and you go back to drilling)you would become HER dependant and she would be entitled to dependant BAH. Of course you both may not collect dep BAH simultaneously.
