My 24 year retirement loses 7.91% against my will because Congress passed the Former Spouse Protection Act, which should be unlawful. When my former spouse refused to sign it away, and I refused to sign it, the navy maximized the Survivor Benefit Program at 55% of my retirement. SBP Premiums cost $145.20 a month, and have never been signed for by me. According to DFAS, it is illegal for my former spouse to pay anything for SBP Premiums, and it is illegal to garnish her portion of my retirement. She is awarded 40.5923% of my earned retirement and agreed in divorce court to pay 50% of the SBP costs. DFAS says my divorce is illegally worded, because of this stipulation. My 59.4077% is raped down to 51.4977% by SBP Premiums that are part of the FSPA, enacted by congress against only married and formerly married veterans. This plainly biased and illegal act was passed, and veteran organizations sued and tried to over turn this biased and shameful congressional act against veterans like me. They took it all the way up to the supreme court and lost.
I lose $1742.40 this year in SBP Premiums, and over $4000 has been stolen to date, to give my former spouse 55% of my retirement after I die. What gives congress the right to target veterans only this way and not include themselves in this shameful act? What gives congress the right to safeguard anything for my former spouse after I die when I soooooo richly paid her for the years I was married to her? She refused to work, she did not cook, she did not clean nor sleep with me for the last 13 years of my marraige. She spent my earnings, and padded her accounts and would not let me got for over 3 years trying to divorce her, after my son grew up. She was awarded $500 a month alimony for a year, and then $225 a month for another year. Custody of my son when she said she would suicide if he lived with me, and granted $732 a month from me per month for child support. I pay school taxes, but since he lives with her, had to also pay $21000 a year for two years for his high school. She got $29379.00 from my IRA to hers, and 40.5923% of my retirement for my life, and then after I die she gets 55%. She also got to keep her choice of our furniture and the car, and all of the money she took from me over the years filling her bank accounts. Congress screwed us royally. I have no choice but to pay for 30 years for SBP Premiums. I can not get 50% back from my former spouse because she refuses even now, to work full time and support my son. My son is a senior in High School, working two jobs and doing modeling jobs on weekends, and keeping his grades high. All of the money he earned is under my former spouse's control and probably squandered.

The Supreme Court failed to give veterans justice. Our president sponsors torture and American Terrorism, and I finally took down my US Flag that has flown day and night in front of my home since I moved back to the US. Our Executive Branch of government sponsors terrorism, our Judicial Branch of government fails to provide justice, and our Legislative Branch of government set up the illegal Former Spouse Protection Act that targets only retired married and formerly married veterans, and signs us up to a costly program that should not be legal, against our wills. DFAS does the garnishing and their hands are tied by the laws, but on top of that they drag their feet helping veterans, and take small pleasures from causing problems when they can, for instance like the illegal garnishment of my retirement that they refuse to correct, that gives my former spouse an extra $60.00 or more per month from my retirement portion since they used only (Gross pay minus Va Disability) in the garnishment instead of (Gross minus VA Disability minus SBP) then garnish it.
I am a very patriotic man, and I am gravely disappointed by Executive, Legislative, and Judicial Branches that perpetuate this crime against me. My Senator Cornyn from Texas is currently looking into my DFAS case, and Congressman Poe is ready to help after he fails. Senator Hutchinson failed even to reply to my plea for congrssional, so she got flame sprayed via email recently for not taking veteran issues seriously by me. I will not display the US Flag while I am ashamed of my government, who is stealing 7.91% of my retirement, and as a result part of my and my son's futures. God Bless America and those who are worthy of his blessing. Our present government sold us down the river and offers no recourse for 30 years. SBP increases by the cost of living increases every year that retirement is increased. Figure out how much I will lose over my lifetime as a healthy retiree working full time at a second career. Factor in the cost of living increases. I plan to outlive my former spouse just to keep her from having 55% of my retirement. When she dies before me, everything paid into this illegal program is lost forever. I may never display the US flag over my house again.... I will take down the lighting I installed for it and archive my flag pole and flags for someday..... If and when a quality US goverment is elected once more, I will proudly display then once more. This Government is a total failure. I am ashamed of them. If you also are being ripped off by this FSPA and SBP Program, now is a good time to total everything up and sing out! The Veteran Organizations and I would love to give the Supreme Court another shake soon.

I read this FSPA when I was working on my claim. And I don't like it one bit. Just more woman's lib nonsense. And I'm sorry it's been dropped on you as the bomb it is.
However, I hope you can learn to forgive and get on with your life. And fly the flag again someday soon. Because our nation isn't just about money and laws and politicians. America is really about men like yourself. Who've served us honorably. And so I hope it will continue.
They have been sending me bills for that since I got out in 04. I just ignore them because the VA is the one that pays me but still. I should be able to drop it since I"m no longer married but I keep getting told I can't. This needs fixed.
