I think our Marine should hire an attorney, in Illinois, provide a power of attorney and letter of agency to someone to represent his interest in his stead. Also, I think someone ought to advise these marine to contact the Illinois Bar association, as criminal acts are usually ethics violations.

YES YES YES He should hire a lawyer and give him power of attorney. The *&^^$ shouldn't get away with it. I have CG stickers on my car and God help whoever keys it. The district attorney should lose his job and the judge should be censored.

While I agree with him hiring an attorney the truth of the matter is he probably can't afford it. I don't see any lawyers taking this without being paid in advance for their services. Even worse the local authority doesn't seem interested in prosecuting this individual for what is in their eyes a petty crime. I am willing to bet that if he had defaced the District Attorneys’ or the Attorney Generals car they would not see it as a petty crime and not worth the courts time. Perhaps they could try to charge him with a Hate Crime. I would like to what Judge Judy would have to say to the Accused Offender. Way to support the Troops Chicago if this is true.

Through the luck of the draw by the computer that asigns cases to judges the judge picked was the one whose personal license plate read "Marine One". I was told that a $100,000 cash bond was set which in IL means just that $100,000 or sit in jail.

For those who did not read the article the Marine is a reservist whose real job is a trader I believe on the Board of Trade and the car was a BWM.

The delay tactic should'nt be able to work. There are provisions in the SCRA that prevent courts from moving ahead on civil actions in a service members absence when the absence is due to service.

I've driven all over this area and no one has defaced my car, instead they give me a 'thumbs up' Of course I'm in CG territory

I think you are on the right track; I was thinking that he should file a civil action in abstencia and use the SCRA to delay the action until he returns. Also, about halfway through the deployment file two separate complaints with the Illinois Supreme Ct; 1) for the criminal act; and 2) for offering to pay the deductible and encouraging the Marine to file a false insurance claim.
If either ethics complaint holds up, there would like be a suspension of Grodner's ability to practice law just in time for the civil action. I would encourage Our Gunner, to ensure that his complaint sought general and special damages against Grodner focusing on mental anguish.

I am confused as to why any of this matters. He is heading for a second tour in Iraq. Sounds to me like lately his real job is being a Marine.

It is his REAL job. Being a Marine is hard even if he's a reservist. He's entitled to respect, not having his car 'keyed' Obviously the people who keyed the car doesn't have respect for the military

In 91 I had a brand new Honda Accord keyed on all 4 doors, hood and trunk...It happened after a bout of road rage between me and another person...

The guy I had a problem with just happened to work on Coast Guard Island in Alameda where I was stationed...He was an ex-Coast Guard Officer...He followed me into the parking lot and got into my face...We called each other a few names and went on our way...I came back out to my car 30 minutes later and found it keyed...I knew he did it...I threatened to cut his head off and $hit down his neck...He denied knowing anything about it...

So to make a long story a little shorter...After a couple of months fighting back and forth, and with the threat of going to small claims court, I was told the only thing the court would make him do is pay my deductable...And he did that...A lousy hundred buck deductable...Costs my insurance company over $2200.00 to paint the car...

Heres's an update on the case from the Chicago Sun-Times web page.

Marine's car defaced,

Nut shell:

DB lawyer calls Assist. DA handling case and says "I'm arriving 30 minutes.late to avoid the media."

ADA tells Judge. Judge say, "That's not how I run my court." Judge issues arrest warrant for DB lawyer, and upon his arrest, has him arrested and held on $20,000 bail.

DB lawyer is convicted of misdeamor, by his admission of defacing the car. ( Marine's family did not press for felony, which they could have.), is given a fine of $600 dollars payable to a wounded Marine charity ( to be paid within one month, or will be sent to jail for 1 year),
30 hours of community service and 1 years court ordered supervision by the Probation Department.

Oh, the Judge former Marine 1961 - 64
ADA Former Marine Aviator/Vietnam
Courtroom. Filled with Marines in Dress Blues or former Marines with Marine pins on coats.

Guess the DB Lawyer learned the meaning of SEMPER FI MAC!!!!!!!!
