I guess the main question I need to ask is this.

Can a manager take a roster and close it out (saying it's exhausted)? When there are still people left on the roster, both of them veterans. And on the same day open up a new accouncement for the exact same job?

Anyone know someone in HR? Or with HR experience that could answer that?

When the fiscal year ends, they can start a new list. That is Oct 1st.

Maybe I should rephrase that.

Can a manager close a register with veterans still on it. Tell anyone that asks that the register was exhausted. Then open a new vacancy announcement (basically starting a new roster)for the same job?

I can understand them starting up a new one. If they need more people. But don't they have to actually exhaust the original one first? I mean the whole idea (supposedly) for starting a new vacancy announcement is that you didn't get enough people in the first one?

Keep in mind we're not talking applications here. We are talking people actually referred to the roster.

Sent the investigator a couple of emails over the past few weeks. He never replied to any. Got a letter in the mail today from him. Pretty much said "Nothing wrong here, move along."

Going to the next step in the process now (MSPB).

Interesting note. When I got the letter it had already been opened (you can see where the glue sections of the envelope are torn). And resealed with tape. So guess someone at the post office was interested in my case as well?

Here is a quote from the letter I got from the DOL-VETS investigator.

"Records show your name appeared on the list of eligible's for the subject vacancy along with approximately 290 other candidates."

And concerning the closing of the first announcement, and opening of the second, he said.

"Vacancy Announcement # NCBG07409331 D was opened to assure an adequate pool of candidates was available for potential future vacancies."

I'm not sure of an exact number hired. But it was somewhere around 30 people. With 46 more to be hired. If they hired exactly 30 then that would leave 260 people on the list.

Why would they need to open a new announcement "to assure an adequate pool of candidates was available for potential future vacancies." with that many people left on the first one? And why tell myself (and I bet others that called) that the first list was exhausted? If there were over 250 people still on it?
