Basic Training |
I was considering enlisting into the air force and recently I was at the wrong place and time with some guys who I thought were friends and caught some heavy felony charges, I have spoken with an attorney who tells me that they can have them dismissed and expunged with no conditions. being this is my first offense ever at the age of 19, can someone tell me if I have any positive options with the military specifically the airforce before contacting a recruiter. Thanks

This is a tough call.
Depending on what you were involved in, how you were involved, what the results were--all this could be moot, depending on the details. The records will show that you've been arrested. When the question is asked, you'll have to acknowledge that you've been arrested, even if the charge is dismissed and the arrest expunged, there will still be a record of it. At the very least, you'll probably need a waiver--someone correct me if I'm wrong, but I think it would be a morals waiver. I think that whatever you bring to the table--ASVAB score, experience, etc--will determine whether any recruiter will work with you. If you were a good kid in HS, good grades, otherwise clean bill, some recruiter might be willing to work with you. But, this is a fact: if you come in the door at the same time as someone who has absolutely NO negatives, the recruiter is going to work them first. Consider an example: if you wanted to buy a house, and you found two that were about the same size, both in good neighborhoods, both had good amenities, but one needed a roof. Which house would you be more likely to buy? Yep. And that recruiter is no different. To him, you need a roof. And if you need a roof, what else might be there that he can't see? I agree with Major. I had a friend that was arrested for breaking and entering and a couple other things. The guy did withdraw the charges and had him do alittle bit of stuff but he is about in the same boat as you. Went to jail but was let off. Last I heard anything from him he was working on getting his waiver and I am assuming that it went threw and he is at basic training or something because I haven't heard anything from him.

Helpful. OP, if you get the charges dropped the AF will still find them. You will need a moral waiver, more than likely. That doesn't preclude you from joining just makes it a longer process. Hopefully you can find a good recruiter who can work with you. It may limit your job selection based on required security clearances. Keep your nose clean in the meanwhile. Drive the speed limit and don't get into any fights. With any luck you can be a constructive service member. |

I was thinking the same thing... Anyway, I had something like this. I was charged, the charges were dropped, and the record expunged. My recruiter told me that even though it was expunged and all I should still do a Moral Determination Waiver. So I did, and I got in. |

If the attorney gets them dismissed (expunged doesn't matter, don't waste your money) then you would need a Morals Eligibility Determination vs a Morals Waiver. VERY similar. The Sq CC would look at the MED and decide if your actions (there were still some action even if there was a dismissal) should keep you out of the AF. Dismissed doens't mean you were innocent.

Are you sure about that? I had a Simple As-sault charge that was dismissed without stipulations. I still need a waiver (as-suming it is the morals waiver) for it. EDIT: lmao @ the poor censoring system. It censors out as-s and u-ck no matter what form they are in. |
