Hello,
I am really not sure where to go for help on this. I am the ex fiance of an active duty ARMY soldier. He was court ordered to pay a certain amount in child support; however, the ARMY has not been sending the correct amount of child support for 7 months now. The payments are coming out of his checks as wage garnishments, but like I said, the amount is not correct (it is less then what was court ordered) and the amount is not ever the same.

He also recently told me that he is now getting BHA (he was living in the barracks); however, I have sole custody of our daughter and we live in a completely different state. He is not married and does not have any other children. He is an E4 and has never qualified for BHA prior to this. I don't really mind if he gets BHA or not to be honest, but I do know that if his wage has increased $900 a month, then surely I should be receiving the full child support for our daughter.

Ok, there is the story...so now my question is this: What do I do in this case? Do I contact someone on post to discuss why I'm not receiving the correct child support amount? Also, I heard from a friend of his that my ex falsified court documents to say that he had partial custody of our daughter (which he does not...I have sole custody and he has not seen her since December) but it seems that maybe that fits as to why he is receiving BHA? I'm not really sure...any advise?

E4s can get BAH under certain circumstances, so that in and of itself is not entirely out of the ordinary, nor is he necessarily scamming the system.

if you have a court order stipulating X amount of dollars and you can prove via the bank that you are not receiving said x number of dollars you can get the command involved to make sure the allotment is set up properly.

How do I go about doing that? Do I simply contact the base and ask to speak with ?? I'm really sorry that I am so ignorant about this, I just have never had to deal with it and it seems like this is the closest to an answer that I have received...

Thank you so much for your help!! Smile
