2 questions


My husband and I are planning a divorce. The only joint thing we have together is a home mortgage.

Hes in c/c debt as well as I. As for myself Im not too worried. But for him I am. He had mentioned that he would just claim backrupt and I would have that too under my belt.

I dont see how I would have to claim "B" unless we sell the house which I know we can.

If plans to file "B" wont he get into trouble with the military?

Yes he is active in the military.

HELP PLEASE?!?!

No. There is nothing that states that he would get in trouble with the military. Bankruptcies are common with divorces and servicemembers are not exempt from the financial hardships that come from it.

There is one modification of MortgageGuru's advise. If you spouse hold certain security clearances, it could become an issue.

Dave_M can you elaborate as to what levels? My spouse has a secret only, and I have heard that they were good for 12 years, he has been in for six. His ex wife stole his identity and we have been paying her racked up debts for years and now that our second child has come along, there is no possible way to do it any longer. Our attorney suggested bankruptcy but he is worried about a secret clearence, and when I was in I thought it only affected top secrets.

What have you done in the way of clearing up the ID theft?

FTC reports, police reports, $88 a month for credit repair using those said reports and disputing each individual debt (not very successful), attempted criminal charges but she left the country temporarily to go home to Mexico and only slips in undetected. Fraud alerts on each of our reports, letters of intent to sue creditors for both removing the info based on the reports and criminal findings that we were not responsible. We have done e very thing that I know to do, and Finance is my business so it' slightly more than the average consumer. It has been never ending for the longest time and she is nearly impossible to catch since her visa was revoked. Currently, even though he is deployed said creditors are filing suit against him instead of honoring the SCRA stay clause. Specifically she purchased a car at a military buy here pay here using a false POA, credit cards in his name where she “froze” his card and added additional cards as an authorized user. The companies wont talk to me since I can’t verify the bogus info she provided for security measures even though I faxed POA’s. As of last month we were paying 1398.11 in her debt that she incurred in his name after their divorce was finalized. Lawyers said aside from suing each individual creditor and hiring bounty hunters to locate her, bankruptcy is the safest bet for him.
