I've already gone through company level with this issue...but just seeing if any of my brother Marines have seen this happen.

My wife and I(at the time) where legally seperated. I had my LEGAL SEPERATION papers faxed, and *RECEIVED(key word received) by the Family Readiness SNCO/ S-1 ADMIN CHIEF! THE ADMIN CHIEF mind you. I deploy weeks later after giving this info to the command and am given no guidance on pay matters other than cancel her life insure. So the problem is, now my wife divorced and I'm back from Iraq...the Marine Corps wants back all of my FSA because they said I was seperated from one date to the end of deployment. !!!I TURNED ALL LEGAL SEP. PAPERS INTO THE ADMIN GOD HIMSELF, and now I'm getting burned on it. Any suggestions on what to do... possibly take this to my Personnel Admin. Center or disbursing before I get checked a ridiculous amount of $ that I was given no guidance on from the S-1 themselves!!!???!!!

IAW the JFTR(Joint Federal Travel Regulation) which is the reg for FSH you are entitled to FSH through the day prior to the DIVORCE being finalized. Legal separation does not stop FSH only Divorce.
