I was on-duty on a story for the European Stars and Stripes in 1981. While covering it I was thrown down a long, dark flight of stairs.
There's no question of the event, another reporter saw it and I have a doctor's statement from 2004 that this injury probably caused a progressively downhill condition.
It's a seizure disorder resulting in memory loss.
This is bad enough for anyone, but I work with my head. I can't write these days and probably won't be editing in a year.
That it is a disability isn't at question when I filed. That it probably occurred on that assignment isn't at question.
I have filed for disability and have constantly been denied. Each time I have been denied it is because my claim lacked something I had not been initially asked to produce.
Now it is a copy of the story.
The story is in the Stripes archives now being indexed in D.C. The old filing system was on index cards and very primitive. The new index is being computerized and has only gone back to 1980 to date. Even so, the amount of data they've been able to retrieve is very limited.
It will not lead to this story because I did not receive a byline for it.
My claim is being tied up looking for this story at the Board of Appeals in D.C. My request won't move forward until this piece of information is retrieved. I've explain this to the one veterans clerk at the Board of Appeals. He still won't move the case before the board until he has a piece of information he'll never get.
I receive Social Security disability benefits for the seizure disorder. I'm deeper than the poverty level.
Your counsel, other than to sue?

A head injury I sustained in the injury has become progressively worse
Have you tried your Congressman or Senator's office? I was injured during a Parachute Jump at Ft Bragg. The VA says the injury is not Service connected. Well, what was I doing jumping out of a C-130 at Ft Bragg then? I'm going to be contacting my Congressman, both my Senators as well as Senator Jack Reed D-RI. Why Reed? He was a Company Commander of mine in the 82nd Airborne Divison.

I agree with gumbydammit; contact your Senator and/or Representative and include any and all documentation. The clerk at the VA is not going to do anything. You'd be surprised how fast things move and how "there's nothing we can do" changes to "we'll do everything we can" when a member of Congress gets involved. If you've gone through all the proper channels already and have done all you can do, that's the next logical step. I've seen all kinds of red tape BS get pushed aside and everybody jump through their asses to expidite something at the mere mention of a "congressional."
14057700, I would anwser your question, but from your profile you are not who you claim to be, which by the way is now a Felony and a Federal Offense. If you have a legitimate question ask, if not go bother some one else, these people have earned the right to come here it appears you have not.

Heres my story, I was in Germany 1984-1989, left Germany healthy, last year I fell at work, (minor) I broke my hip in 3 places, the Va in Lebenon said apply for benefits. I did guess what I was denied. said I needed to prove this injury is military related, I went in the army with no bone or thyroid issues now I have many. Both issues are related to over exposure to radiation, Chernobyl was the closest I got other than 1 xray on my finger in 2001. after the fall they found that I have severe thyroid problems and osteoporosis, here is the topper. I am a 42 year white female, otherwise healthy, how to I prove this to the Va, it already took 1 year and they came back with it may or maynot have been from the fallout!!!
If it is a copy of the story you need, you can get one from somewhere other than the Stars and Stripes itself. Go down to your local library (the bigger, the better - University library if one's around) and ask a librarian to help you get it through Interlibrary Loan. I'm assuming you know about when the story ran, so it shouldn't be too hard to pin down. I did a quick brows through WorldCat and there are dozens of institutions that have Stars and Stripes. Granted, most are the war years 1918-19 & the 40's, but some have holdings beyond that (S&S Pacif, S&S Med, etc.) all the way to current issues. Somebody out there has the issue you need, the librarian can help you find it. That's what they get paid to do. Good luck to ya (yes, I work in a library) Now, if the story doesn't really help you because you didn't receive a byline, at least you'll be able to show the VA; 'here's the story you insisted on asking for - my name's not on it!'

OK, lets start at the beginning. What is the basis for your radiation claim? If it based on Chernobyl, there is about 1,500 miles between any US base in Germany and the site in the Ukraine. The key to getting a claim approved is proving that something happened in the service. Tell us why you think that is the case.
