Recently my daughters husbands mother spouse died. Hope that makes sense. He, the spouse or step father was rated at 60% service connected about 2 or 3 months ago. He died Nov 16, 2009. I not sure if what he died of was one of the service connection or not, or does that matter? Will his wife be able to collect any kind of DIC income as she is 72 years old and on a fixed income of Social Security. I am inquiry for her behalf and would like to find out some kind of answer or a direction that she may pursue. Thank You
My understanding of the law is that she does not meet the threshold for DIC. The timeline used for the "Effective Date" of Disability Compensation & Rating is crucial in determining any benefits, if any, she may possibly qualify for.
Thank you for your quick response.

There are two ways that she may qualify.
1. He died from a service connected disability.
2. He served during a war period and her income is below a threashold.
The information is at http://www.vba.va.gov/bln/dependents/spouse.htm
A good service officer, whose services are free, can help with these issues.
