Just wondering.. have many of you had this problem as well? My DD-214 was supposed to be mailed to me since I took 35 days terminal leave before my official retirement date (ret Aug 11th). I can't get ahold of anyone at my personnel unit to find out about it, and in the meantime can't get ahold of anyone at MyPay to find out why my retirement pay isn't starting on time! I'm so frustrated right now.. I was under the impression that everything was 'all set up' before I left on terminal leave

If your retired date was Aug 11 then you will not get a check until the first of Sep. I did not think retirement dates were in the middle of the month. I was active duty for 28 years, the retirement ceremony was always at the end of a month.

Everyone retires at the end of the month - it's always the last day of the month. Are you sure you didn't ETS?? Did you apply for Retirement?
I spent two months fixing two CSM's who thought they were retireing after 30 years but actually cleared post on ETS orders because they never submitted a Request for Retirement. What a mess. They called our local DFAS when they weren't receiveing retirement pay (back when the DFAS wasn't specialized). The DFAS relealized that they both had seperated on ETS orders. The G-1 didn't know what to do so they ask Post Retention for help. They did receive their retirement and pay after more than 6 months after they had ETS'ed.

Good info, but may I make a correction? Not everyone retires at the end of the month. If you are disability retired then it may be any time during the month. I was disability retired effective 14 Aug 2007, for example. I am sure there are reasons related to timetable rules and etc...

I would love to. But this is a very complicated question. I was hoping my previous post would cause the person who posted the question to provide additional information. But he/she is no longer a member of Military.com unfortunitely.

I would like to have known which branch of service he was in so I could have referanced the appropriate regulations (Army, Air Force, Navy). I would **** to know if he/she was Active duty or Reserve/National Guard (either active duty status or TPU) or IRR/ING or if he/she was separating from the new Wounded Warrior units.

Different Branchs of service have different but similiar regulations to work from. I luv researching out the answers but I have to have a starting point.

It also makes a differance if it is classified as Temporary or Permanent Medical Retirement. (And don't get me started on the problems with the bringing a Temporary Medical Retirement soldier back on active duty once their condition improves and they are found "fit for active service", lol).

But, how about the basic question of that person claiming to have been retired in mid-month?

I referred it to you because of your exposure. I know the US Code, got my law degree, but once in a while a new one "pops" up that I can't find.
I know that all retirements are at the end of the month, but here we go, after the above post, I come to find another similar situation, and now would like to know for myself, what is it, valid or an odd exception?

I'll have an answer for you in a few of days, had all ready downloaded the current regulations and have been reading through them as I wanted to know in case someone else had a similiar situation. I retired in "04" and found that most of the regulations I kept were updated in "06". Got to do some reading when I get the time.

I apologize for not posting a follow-up sooner than this. Thank you all for your info contributions, it is much appreciated. btw I am still a member here but things have been VERY crazy with me lately. To clarify some things.. I did recieve a disability retirement effective Aug 11. That's why it was in the middle of the month.. basically I got to choose whatever date I wanted after finding out they were retiring me. I was active-duty Navy and the reasons were non-combat related (although they were service-related).

In October things finally started to sort out and my retirement pay started Smile However, my personnel command in Norfolk actually sent out my dd-214 WITHOUT an official signature. This not only caused a major delay for GI Bill amount benefits (they had to keep me on active duty rates), it also got me denied for unemployment benefits. I had to send my unsigned 214 back to Norfolk, then play the waiting game again (not silently I might add!)

As of now I am apparently inelligable for unemployment because of my disability retirement. So I applied for Social Security disability benefits.. guess what.. denied there too! I'm now waiting my appeal paperwork to process so I can go before a board and prove I have a disability. Apparently all my paperwork from the military doesn't mean anything to them, snce they had it all when they denied me! Frown

..any advice on all that?..

I WAS MEDICALLY RETIRED ON 22JUNE 2008 AFTER SEVRE INJURY CAUSED ME TO HAVE THREE EMERGENCY OPERATIONS AS A RESERVE ON ADT ONBOARD USS JFK. AFTER A 4 YEAR BATTLE THE NAVY FINALLY SAID OK YOUR PHYSICAL EVUAL BOARD FINDS YOU MEDICALLY PERMENATNTLY RETIRED. HOWEVER THE FOLKS IN MILLINGTON TN HAVE SAID YOU DO NOT GET A DD-214????? I APPLIED TO THE VA IN ST. PETE FL FOR VA DISABILITY BENIFTIS AND THEY SADI NO DD-214 NO BENIFITS!!! THE FOLKS AT NAVY PERSONEL COMMAND SAY NO YOU'RE NEVER GOING TO GET A DD-214, YOU HAVE TO TELL THE VA TO REFER TO CFR 38 3.1 AND THAT IS ALL THEY NEED. SO I CALL THE WHITE HOUSE AND GE THE DIRECT PHONE NUMBER TO THE VA SECRETARY GEN SHENSKI AND TALK TO HIS ASSISTANT WHO SAYS THE NAVY MADE A MISTAKE YOU CAN NOT BE MEDICALLY RETIRED WITH ALL THE BENIFITS OF A RETIRED NAVY SERVICE MEMBER WITH AN HONORABLE DISCHARGE AND NOT BE ISSUED A DD-214........SO AS OF THIS AFTERNOON THE VA IS DENYING MY BENIFITS AND THE NAVY REFUSES TO GIVE ME A DD-214...........I HAVE SPENT THE LAST 4 HOURS TRYING TO FIND WHERE IT SAYS THAT IF SOMEONE IS MEDICALLY REITED FROM A WEEKEND WARRIOR RESERVE TRAINING STATUS TO MEDICAL RETIREMENT WITH FULL RETIRED BENIFTS AND BE DENIED A DD-214 I ACNT FIND IT ANYWHERE OR I JUST DONT KNOW WHERE TO LOOK TO MAKE THE PERSONEL FOKS IN MILLINGTON TO ISSUE ME A DD-214 I AM STUCK IN NO MANS LAND WITH NO VA BENIFTIS WHAT SO EVER???????????PLEAS ESOME ONE HELP ME, PH AUGUST

Sorry for the caps. they gave me the complete finding of the peb along with the pdrmessage from navperscom and the letterfrom the nosc orlando that says on 33june you are permenantly retired. the peb say 50% disabled and the navy medical board says i am never going to be able to work again and shouldrated as "iu" by the va

Start with a member of Congress or a Senator. They all have Veterans and Military Liasons. They should be able to help. Also, contact the JAG who worked with you on the PEB.

Check with the National Archives to see if they have a copy. All discharges are recorded their and copies are available free. http://www.archives.gov/veterans/evetrecs/index.html

You might try a NSO/VSO from one of the major veterans groups.

I know this sounds really navie but i have never been on a message board before so i am not familiar with the correct procedures

i have the florida depart of veterans afairs and the us senator bill nelsons office helping and they all say the same thing it si impossible to be medically retired and not be given a dd-214. today i had the senators offcie speak with the senor master chief lewis at milington and they said to them all again no you are not goign to get a dd-214 but no resason that any of us can understand!! very frustrating
