When I returned home from SRP yesterday, I noticed my dogs were missing. After some investigation, I decided to call the ex-wife to see if she had them (the week before she had called me and said she wanted to keep them while I was deployed). She had them, and said she was not going to give them back; furthermore, she has filed a restraining order against me. Now I know a little about the law, and I am sure one cannot just get a restraining order against someone because they are mad at them. Monday morning, my first call will be to my lawyer. I don't harass, call or write threatening letters to my ex-wife. There's no history of domestic violence on my part (except for the time I physically threw her boyfriend out of my house (perfectly legal here in Texas, and the law was not involved)). I haven't even been in the county she lives in since May and then I was visiting someone in a different town. I am wondering how (if a restraining order is filed) will it affect my going on deployment. I'll find out more about how real her threat is Monday, but if there's any JAG types that catch this, or anybody with this experience, please share if you will.

Snipe, you get a copy of that Order yet??
I don't know what to tell you about that though...seems odd that one would be given if you've never had an altercation with her.

As far as the pooches....who legally owns them?

Sorry, but I'm just now seeing this. When someone removes property from your premises without your permission, you file a police report to document the theft. Then contact the detective to tell him you have located your stolen property, based on statements by your ex. No restraining order issues there.

I'm with the police report and stolen property path. No reason for a restraining order and won't impact deployment. Care for the dogs like your children and have a care plan establihed for your deployment.
