Hello,
I have unfortunately heard back from my MEB/PEB for chronic PTSD, and Lumbago( Lower back pain. ) All of which were said to have Existed Prior to Service.
I'm wondering if I should even bother filing a claim to the VA with no rating given from the PEB findings. I was given a Chapter 6(EPTS)Discharge. I have not gotten my orders yet.
Although it did say all of my conditions were aggravated in service, but not permanently. How will the VA look at this? Someone help...

After having surgery a year ago I am still arguing with the VA about my back claim... (I also work at a VA clinic)...

Claims can be, and usualy are a long slow drawn out process...

YES YES YES The VA although similar rates you differently than the CG. Also if you have any other ratable items the VA will look at them. The CG only cared about the items on your medboard.

Also get someone from DAV, AMVETS, etc. to represent you. Call them and request to be in contact with a veterans service officer they will help you file with the VA at no cost to you.

Absolutely file a claim for aggravation to a pre-existing condition. And, as EMC_ said, they will look at other ratable conditions. But your best advice is to see someone at the DAV or other service office to help you with your claim. They know how to do it, and using them will streamline the process for you.

Thank you for the posts. I should wait till I am fully separated to contact a VCO or a DAV? So for instance I will be heading to Seattle, so I should contact a VCO in seattle? ...

First make a few copies of your medical record. Have then certified by an HS. Then keep your original medical file and the copies. You will need them to file with the VA. If you are going to live in Seattle permanently that is where you want to file your claim.

When you get settled contact the nearest AMVETS or DAV office and tell them you are looking for help in filing a claim with the VA. Do it as soon as possible, if you file within 1 year of seperation any benefits are back dated to the date of discharge. As always there are people here willing to help so don't be shy about posting or e-mailing us with any questions.

Has a discharge date been determined yet? I would not wait a single day. Call your nearest DAV office and tell them your situation. You should be able to file your disability claim before your discharge (while still on active duty). That process works more quickly, and the effective date will be the first day of the month following your discharge.
