There is no rating for GERD or Acid Reflux in the CIFR. There is case law that it can be found to be disabling for VA purposes. If you have a condition caused by GERD, then that could be considered. You will also have to prove a Nexus to your service, and in this case it would probably would have had to be treated while in service or diagnosed shortly thereafter.
This is a very hard disability to win unless you have secondary issues.
Dave I tried to post this before but my screen when to Military. com when I submitted it. I have army medical records that show I was treated from 1973-1990 for acid reflux and have been on med's from the VA doctor since 2001 for this condition. If this is not a rated condition am I just wasting my time trying. Sgt D "Never did like pushing a chain"
I have looked over the CFR and tried cross-referencing every which way. I can not find something. If you could prove that this reduces your ability to earn a living, then you might get it rated on the rules that allow them to rate no listed conditions.
I looked everywhere to find it. I also search the Social Security Blue Book for the words Acid or Reflux to see if there was a disability listed there. If there was, then you could use there standards to convince the VA. NADA.
Acid reflux is not a disease, it is a symptom. VA does not rate symptoms as service connected. Thus Gastroesophageal Reflux Disease would be the condition you would file for service conenction. It is usually called GERD. I have quite a few veterans, service connected for that condition.
Dave B Thanks for the info. I went down this am and saw my VSO and filed for Gastroesophageal Reflux Disease. Now I guess it's a wait and see game to see how the VA handles it. Maybe I can at least end up with at least another 10%. Thanks again. Sgt D "Sometimes pushing a chain works."
i have acid reflux and irritable bowl and was given a rating of 30% for gerd, not seperate conditions, i had it all documented in service and probably some of the worst conditions, throwing up blood, pollups, and a bunch of scopes done. hope this helps, i would also tell aanyone thinking of using any va benifits to go thru the TAPS class that will explain all your rights and benifits.
Filed the claim on 30 Jan 2008 received letter today requesting more info if I had any and to send in or sign form and return so they could continue with my claim. I have a couple of buddy statements and two hospitals in Virginia I was in to send to them, I'll get that back to them then I guess it's wait on a C&P and see how it goes from there. So about 60 day's from start to this point. Sgt D
I received a decision on this last week..I was awarded 10 %. I never had a C & P exam I guess that my service records and civilian medical records were enough to get the rating of 10%. However in real math I'm 80 % but with the VA math I'm still at 60 %. Go figure...Sgt D
If you read some of our posts on the topic, the VA adds additional disabilities to the residual - so if you have one at 40% and one at 10%, the second is at 10% of 60% or 6%. And the add a third at 10%, or 10% of 54% of 5%. That total is then 51% or 50%.
