ok this may be kinda long but bear with me thanks. 27 yr old P&T disabled vet got 50 from the army and got 90% plus I/u from the VA.. heres my story back in 2004 got burned in a explosion in OEF5 and got 3rd degree burns on 30% of body hand face skin grafts etc well now that im a little older heres my breakdown 10% neck 10% knee and only 10% for my skin grafted hands which is what im trying to raise, 70% ptsd and 30% facial scars. im like 130% disabled but only at 90 with 10% I/U what the hell?? heres my new questions im asking for a increase on my hands because the grafts keep splitting during the winter and they HURT and the summer they blister since i only have like 4 or 5 out of 7 layers, secondaly im asking for a new rating on my back i have L4 and L5 hurinated disc they never put it in my medical records since my they classified it as my neck WTF. Mind you i have been to the ER 5 times for my back and getting injections in decemeber for the pain. then asking for increase for TBI i was never even evaluated for it!!!! didnt even know about it. i was knocked out for 5 days coma from the explosion so i think i qualify. SO im trying to get to where im scheclure or whatever that means where i can work. Im going nuts not working but my family reley on that money. So what im asking is am i likely to get a raise on my hands and will it go back to the date of the accident as well as the TBI, as for my back what will happen with that? Anyone with a brain knows its from the accident and never had a back problem before. and im going to figure out what they are going to do about my neck? its is constiantly hurting and popping. Im just curious what am i getting into, my va rep got me my TSGLI 100,000 back in 06 and she is on top of her game and is very knowledagle. She just submitted everything yesterday. Am i a canadate for 100% and able to work?? if so what are the requirments and etc. Any info would be great guys thanks a ton also recieved purple heart and tons of medals was infantry stationed out of 25th Id schofeild bks hawaii!!
According to the VA math calculator that I used, if the VA changes the one 10% award to 70%, you would have a score of 94.897. If they round it up to 95%, you will get your 100%. The awards are not based on medals. As I understand, the awards are based how they feel your service connected disabilities affect your ability to earn a living. You have 100% now. When you bring your file to their attention for an upgrade, you open it up for a complete review. Hope I helped answer your question. TBird
WOW!! i know that disabilty is not based off medals geez. im asking for increases on 4 of my disabilties and it does not open the door for everything im permantly retired. My questions are has anyone gone through this sort of action, having skin grafts raised up on percentage only 10% is a slap in the face total disfigurment! and not being diagnosed with TBI is a joke i was in a coma for 24 days!! i think i qualify for that. UMMM, my back is so bad that im having surgery and i was wondering since it was not in my medical records what are they going to do? anybody would understand that it was accident related since my whole spine got compressed in the humvee. just wondering if they will go back from the accident or the date of file on all these?? Not trying to come off rude but very upset with the way the VA is handleing this! the tbi doctor said i dont qualify for it, she said its all in my head. im like are you freaking kidding me i spent 2 years in the hospital at BAMC in sanantonio!! anybody gone through any of these hurdles???
plus as i sit right now im at 130% disabled whats the cut off for SMC??? im trying to become a corrections officer and im on the list and really need to get my IU lifted. I want to be 100% and be able to work is my total goal. I need the money to support my wife and 2 kids and the extra money from being a CO would be great.
how long does the whole process take?? is there back pay involved, after todays visit i contacted my congressmen and a couple of orginazations and let them know how the doctor treated me and what she said! They were blown away and said that was so uncalled for. If i could post pics of what happened i would!
Shouldn't be to hard honestly it all stems from each other. I'm like the burn victim poster child lol. 5 million dollar surgeries in 2 years. Been through a lot. Plus got the congressmen on my side and I've gone to the media before. They don't like that and I do have a vso who is the best in my opinion. She said I'll have no prob getting it. Conditions r worsening not getting better with age.
Heading down to brook army medical center soon to have my doctor who did all my original surgeries. He is going to do a whole new write up on what's going on. He is the best burn surgeon and he's military full bird colonial. So he's gonna re write up my hands burns on face. Get me in for a tbi so I can get a percentage. Sim not even rated wtf. Also look into my back. That should make this process a lot easier. The va shouldn't say crap. He's the best in the business. Any thoughts if this will help me claim.
Thank you for your service. I think I understand from your original post that you want to increase your schedular rating to 100% so that you can work. Have you considered filing for SSDI intstead. I believe you have a strong case. If you have children under 18 they are slso eligible.
I highly recommend you work with a VSO who can help you figure out if there is a possibility of getting 100% schedular. It is near impossible based on multiple disabilities, but it can be done if they are rated at 60% each.
I do not have enough information or the skill to do a complex case over the internet. Please set up an appointment with a VSO and see what they say. If you need help locating one, tell me where you live and I will find the closest ones for you.
I already get ssdi it's only 815. What happens if I have to kids 5 months and 5 years old?? I'm trying to get 100% where I can work without restriction.
When you have SSDI, your 2 children should also receive at total of 1/2 of what you get. at $815 you should be receiving a total of $407 split between them (SS rounds dollar amt). If you are not getting it, you should go to Soc Sec ofc and apply for it. If you do work you will lose both yours and their SSDI.
