Hi, I found out today that in my left eye which was misdiagnosed over two years ago can’t see past a 30 degree radius. My right eye can be fully corrected after contact lenses with no other faults. My left eye does make it very hard to drive safely. My question is does this equal legally blind, and what should I expect when I get my disability percentage back?
Here is the definition:
Your vision is 20/200 or worse in your best eye, even with corrective lenses or surgery. According to the federal statute that defines legal blindness, a person also merits the designation if he or she suffers from severe tunnel vision, with a visual field that measures at most 20 degrees in diameter.
I am told the VA might not approve my claim since the only evidence during active duty was misdiagnoses of my left eye. What should I do?
You do not meet the definition of legally blind. If the VA rates you as SC it is a 10% disability for one eye. If want to move forward, contact a VSO. 10% pays $117 a month.
Im sorry I gave you wrong degrees numbers for my left eye. They are 10 degrees up, out, down, and 15 degrees in.
The above link is where I got my compensation information which has only having it in one eye equals out to 20% to 60% but has an increase of 10%. IDK why my civilian doctor is calling legally blind though..
Field of vision in one eye is only rated to 30%. Your doctor can call it anything, but the US standard requires the level I posted above and it is based on your best eye.
More critical is that you still have to prove service connection and that seems to be a problem. If you feel you have a case file. The only doctor who really matters is the doctor who examines you for the C&P. Any without the required nexus to the service, that may not happen.
I figured I would update. Friday I had another appointment with my civilian doctor who gave me a color test. I was unable to pass but only by a small margin. Now the VA is going to do the same test. I figure this might be helpfull for others when I say if you can find a good civilian doctor. Mine has made several phone calls to the VA which has pushed my VA appointments in to days and not weeks or months of waiting time.
