Unemployment Benefits Issue--Louisiana

This is the first time I've ever posted, and unfortunately it is a major gripe. PCS'd from Louisiana to New Jersey in December 2008, and I had to leave a very good job as a result(I work in the medical laboratory field). I started looking for work before we moved, and four months later am still searching. In the meantime, I filed for unemployment with Louisiana, and was initially told my claim was approved. That was in December, and as of today, I have yet to receive a dime in benefits. The LA Workforce Commission apparently has one person that answers a phone line, because no matter what time of day or what day of the week, it has been impossible for me to get through--if the line is not busy, I'm told there are too many other people waiting on hold for my call to be held as well. After a series of letters telling me various reasons why I could not be paid for the previous week (with no explanation of how to sort out the whole situation), I received a letter today telling me I was not entitled to benefits because I left a job for no good reason. The letter goes on to tell me that if I have questions to call. . . you guessed it, the previously mentioned imaginary phone line. Before I filed, I checked, and Louisiana supposedly offers benefits to spouses of military members who must leave a job due to PCS. I can't file with New Jersey's because I haven't worked in the state. Just wondering--has anyone else had a nightmare of a time with the system in Louisiana, or any other state, or feel like someone out there is hoping you just give up trying? I am frazzled! |

Unemployment laws vary from state to state as to how they handle military spouses. You will have to appeal their decision.
Personally, cases such as this and SSI payments get turned down initially and they count on you to not appeal the decision so they end up paying. You may want to contact Military One Source to see what help they may be able to offer. They are supposed to help somewhat with legal matters. Update--I am appealing, but expect to be turned down. Louisiana is one of 20+ states that deny unemployment benefits to spouses who must leave a job due to PCS. When I asked for information, I was told I was entitled to benefits, but state law has a nice little caveat that says if you become unemployed for any reason other than action by your employer, you are disqualified.
I'm adding this to my list of things I'd like to see more equal from state to state. I have plenty of time to make lists these days |
