I am stationed here at west coast and I am Navy; and he is stationed east coast and He is marine.We are both E-4.We met when he went for det here (west coast).Then He went back to where he is stationed. We got engaged when we visited his family at Mississipi. And we got married when he went for second det (DTY)here, March 2009 . I moved and live off base after we got married. I am receiving BAH Single. After two week of our marriage he went back to east coast. He routed a chit to live off base as soon he arrived to his command and still have no answer about it. For us to see each other, either I or him need to take leave. And i need to rent hotel room everytime i see him because I was not allowed to his barracks room. I've been selected order to Washington State and I am PCSing March 2010 and we are not allowed to co-locate because he getting out July 2010. And he will going to follow me there. Here are my question.
1.) Are we elegible to received separation pay (FSA)now? We cannot be together now because of military order.(We spend almost 1000$ everytime I see him, plane ticket fare and hotel room.) I've been asking a lot of person and they have different answer. 2.) Are we eligible to received separation pay when I move to washington state,(March 2010 to June 2010) he cannot move with me becuase he is still attached to his command until July 2010? 3.) What is the regulation for E-4 marine in aviation, married to MIL, to his living situation? What publication or instruction? He routed a chit but no answer for 5 months. I didnt route a chit, but as soon the psd received my marriage certificate they allowed me to move off base. But why marine doesnt? It is command discretion? 4.) Does Marine or Navy will pay for his move when he will going to follow me on my next station? I am new, this will be my first PCS Move, I am only 23 months in the Navy. |

This is hard, and the reason you are getting different answers is because the instruction is vague. In some cases, yes you are eligible (for type 2 if memory serves right), but there are too many details we don't have. Example, in our case DH submitted for it and his was denied because it is only paid out to the senior member. Then I submitted, but was denied because we "chose" the orders. Do you have a co-location request chit on file at pers? Adding to complexity is "same geographical region" for co-location orders is different when you are talking different branches and not the same branch. JFTR chapter 10 states that as dual mil you are treated seperately for BAH. So, he is concidered a single E-4 with no family in the area. Therefore, the command does not have to give him BAH. I know the cost of living apart sucks, BTDT, but it's a risk you take being dual mil. especially in different branches of service. when he gets discharged he will get a HOR move. If WA is further from whereever he is than his HOR, you guys will have to pay the difference. |

As far as I can tell you don't rate FSA because the military didn't separate you two. You both entered this arrangment knowing you were stationed on different coasts. In essence you CHOSE to be separated.
Usually FSA is reserved for a military couple that is stationed together and then one of them is moved away to a different duty station. In that situation they'd rate FSA because the MILITARY gave them orders that separated them. Another instance that would be similar to yours is service members whose wives stay at the old duty station because of a job or school they have to finish. The service member does not rate FSA because they CHOSE to be apart. I hopw that makes sense. As far as him being allowed to live off base, it's up to the command. Period. The Marines is not the Navy and they do thing differently for a reason. They may let him move... they may not. The Marines will pay for his move "home" once he is done with his contract. |
