I have 18+ Navy years. Seven (7) years as an officer. Joined the Guard. Will deploy and claim sanctuary. I am now enlisted. What will my retirement pay be based on. My status as an O3E or as an E5?

I will defer my answer concerning your Q regarding retirement at what grade until I hear a couple of key points, both of which I believe this service member already knows to be. "Will deploy and claim sanctuary" is a good place to start and you can provide the answer email through Military.com

An update: How long were you actually out of the service before you joined the Natl Guard? and how long have you now been in the guard, and when do you anticipate your qualification for retirement, and is that calculation age based or reserve credits

1) I will be deploying to Iraq through a national guard mobilization later this year. Pretty soon.

2) I did 18 years, 5 months with the Navy. Almost 8 as an officer.

3) I was out of the military for 12 months, 15 days before joining the National Guard.

4) I have had continuous service with the Guard, as an E5, since December 2006.

Were you RIFFED?
If not, then you retire at the highest Rank you held and that you held that "Officer" rank for a period of over two years.

The Kicker is that you were out of the military for over 12 months, with no inactive reserve requirement, you would retire at the highest grade now achieved. UNLESS, you find a way or perhaps you did some type of inactive service, in which case the 12 month rule would not apply.

Hold that thought for a day or so. I will call someone at DOD that I know who might if it is possible change that.
Another issue that I know of is that we are talking about retirement rank and not retirement pay, right?
Rule #2 If an Officer reverts to an enlisted rank, he will hold his officer rank as his reserve rank and at the time of his retirement from the service shall be granted retirement ceremony of his reserve rank. It does not apply to retirement pay. For that, you have to revert back to rule #1

Maybe someone can give me some insight because I am in the Army National Guard and in 2 months will have 20 years, 4 of those years active duty. The reason for posting this is I would like to know who to get in contact with on whhy if I served 20 years in the military why can't I be compensated? I took an oath, went to war, why can't I get something?

what was on the table when you took the oath, what was the deal. dont think it is in the cards to get credit for the national guard years for retirement

like has been said here before, what was the deal/offer when you started this evolution and correct me if i am wrong was not there always a possibility of mobilization and war taking you along?

I am looking at Title 10 USC (Retirement etc.,)
and 18 USC for pay, bennies, overlapping rules and guidelines between those 2 codes. I apologize for the late response, but I come and go and do not work for Mil.com in any capacity. More often than not tho, someone comes by and finishes or opines, so you have your answers you look for in a short time.
