Short topic, won't go in detail just looking for someone who has had this happen to them also.

My wife (now ex) and I signed the SBP waiver when I retired. Four years later DFAS started taking a portion of my retirement pay since my ex had dated the waiver four days before I did. Has any one ever had DFAS take some of their pay to "back pay" SBP costs?

NO. Are you sure this is why that took some of your retired pay for back SBP cost??? I would not think that the date off by 4 days would have anything to do with SBP cost.

Your ex wife can receive up to 50% of your retired pay if she was married to you for 10 years of your active service time.

Did your wife leave you 4 years after you retired?? If so, then I would say she is getting the money that DFAS is taking from your retired pay.

Thanks for the reply. I am absolutely sure of this. I even have the letter from DFAS stating that the 4 days is the SOLE reason I owe back SBP. My ex is getting 50% of my retainer pay. But it is 50% of the total retainer pay. I have to make the SBP payments out of what I am getting. They are taking out over $400 a month in SBP costs. Between what she gets and what the SBP payment is I get hardly anything. Luckily it ends this month. But I still want to recoup the money. I have started to look into my legal rights. I would like to find others who have dated the form incorrectly. Thanks again for your reply. Sam
