The subject may sound a bit confusing but I can't think of a better way to express my question. I read something a while back about a possible bill in Congress to evaluate a veteran suffering from PTSD (for instance) who left the service before serving a full twenty years. On a case-by-case basis, the veteran's case would be examined to see if the PTSD or other condition would be responsible for cutting the military career short. If so, the veteran's status might be changed to that of full retirement. Can you shed some light on this? The DVA counselor at VAH Louisville was unaware of it?

this is a retired veterans forum (although my vet is not technically 'retired' they have helped us get some answers..I joined to help my husband get all his benefits...he actually falls into the same category you described..right now he isn't eligible for CRSC (COMBAT RELATED SPECIAL COMP)OR CRDP (COMBAT RELATED DISABILITY PAY)(which is simply You get an 'automatic' increase in VA benefits IF
you are eligible for this...you have to go through a 'process'
he was medically discharged with SEVERANCE PAY due to injuries he received while training for Vietnam, he did his tour of duty in Pleiku RVN 68-69.& he attempted to continue his career by going to college while he was on Chapter 31 (REHAB) and while getting his degree ,went to ROTC, re entered the ARMY as an Officer.(2Lt.).but he had to give it up when he 're-injured' while on tour of duty in Korea
he has seemed to fall into that 'Grey' Area ever since....we managed to get him VA rated for
100% service connected (perm and tota)but this
came at the cost of him having to PAY BACK the Severance Pay ( they RECOUP SEVERANCE PAY!which is based on Length of Srvice,Rank,etc. when they pay you VA benefits for the original injuries!!) awarded when he left the service! (this is another disservice to veterans that needs to be changed!)
write a post to the Ch.61 group and they should be able to answer your question (I hope!)

I know of no legislation that is expected to be enacted into law (versus introduced and not being referred for hearings) that will change VA SC to retired. There is a law that requires the DOD to reconsider recent discharges to see if they gave a veteran of Iraq of Afganistan too small a rating for their disability. It is not for just PTSD. But it is not looking more than 10 years back. The VA is not involved in this effort.

wb4gad - you are very wrong in your answer - you are mixing concepts. In addition you post violates the terms of service. We do not allow links like you posted.

The OP asked about the legislation that requires the services to review discharges and for those under 30% to make sure they where nt rated too low. The person did not understand first this only applies to recent discharges and second was a DOD and not a VA matter. The second poster then inserted chapter 61 into the discussion and a link in violation of the rules.

I write from my vacation (first day) overlooking a very smoggy Virginia Beach.
