Trying to understand this, I hear too many different stories. If someone was in the Navy and was discharged with a RE-4 OTH Misconduct and a separation code HKA. And say they wanted to join the Army 5 years later, can that person be granted a Waiver?, or does he or she even need a waiver?

The best place is the National Guard, the can waiver you in, they do not care about the RE-Code, the care about the Character of service, you can get in on a OTH, if you have Bad Conduct then you need to hire an attorney to approach the board of Corrections, William Cassara is an attorney who specializes in this!

This is straight from the Army Regulation 601-210. Can be found on page 27. This is for Army and Army Reserve enlistments.

U.S. Navy and U.S. Coast Guard reentry eligibility codes
Code Definition

RE–1, 1E, 1R, 3J, 3M,
3X, 5, 6 and 7
Applies to: Eligible for reenlistment.
Eligible: Qualified if all other applicable criteria are met.

RE–3A, 3B, 3C, 3D,
3E, 3F, 3G, 3H, 3K,
3L, 3N, 3P, 3Q, 3R,
3S, 3T, 3U, and 3Y
Applies to: Persons separated with disqualifications for retention.
Eligibility: Not eligible for enlistment unless a waiver is granted.

RE -3A, 3B, 3R, 3T,
3U, 3Y, 3Z
Applies to: Persons separated with disqualifications for retention.
Eligibility: For AR fully eligible for enlistment.

RE–2, 3V and 4 Applies to: Ineligible for reenlistment.
Eligibility: Not eligible for enlistment.
