HI SGT. SHAFT IM IN THE NATIONAL GUARD WITH 18 1/2 OF SERVICE.I HAVE A 2005 PERMANENT PROFILE WITH CONDITION IN MY BACK AND RIGHT SHOULDER.LAST YEAR IM HAVE A ACCIDENT WITH MY RIGHT WRIST.IN APRIL I HAVE A SRP AND THE MEDICAL COMMAND NOTIFY MY UNIT TO PREPARE A PACKAGE FOR A MMRB.MY UNIT TOLD THAT I HAVE OVER 18 OF SERVICES I DONT NEED MMRB BECAUSE IM LOOK IN SERVICE.THEY TOLD ME WAIT UNTIL THE END OF CONTRACT OF 20.IT THAT TRUE?? |

I will guess that you are in the Army National Guard. If so, you may want to post this question at Army Reserves & National Guard.
I'm not sure of the status of what used to be called, back in my day, "sanctuary" - hit the 18 year mark and you are locked-in. I believe that it is not uniform among the five branches of the armed forces. I'm told from a very reliable source that the Coast Guard does not have such a policy. To answer your question Albert, your Command makes the decision. If you disagree with Command, you need to go through the channels provided. There is not enough information provided to give a detailed answer. In the 1980's I represented a Navy Chief who was six months short of enough time to retire, when on duty he fell and severely injured his left wrist. The wrist was permanently disabled. His rate was in an administration occupation. His CO a Navy Captain ordered him processed out with severance pay. He appealed and I represented him. The case finally went to Bureau of Naval Personnel, where it was ruled he would be placed on a profile and finish his enlistement. You need to contact your Legal Officer for advice. I would have liked to talk to you before you went for your screening.... I would ,if I were you, check to see if your covered because you have 15 years or more...but htose have to be good years at least 48 points..if so your "Retirement" would be based on points and years..and you would still get your "Retirement at 60" which is obviousely your concern. When I retired that was still in effect. On the other hand, you have your rights to appeal whatever they come up with.. Now I am ready to "TAKE THE ROUNDS" |

thanks for the clarification, the new Rx I am on seemms to be working with the blurr..
o.K...got it, the reason I asked was it states a sgt shaft, so I thought it was strictly for him or the MOD's. I see that you/Bruce & James already posted to the Soldier, so I'll pass. Btw..DAVE..this forum?..is that what it is? actually contains alot of good stuff, I wonder how many are aware, casue I stumbled onto it. |
